Showerhead Giveaway Sweepstakes Rules

OFFICIAL RULES

1. ELIGIBILITY. NO PURCHASE NECESSARY

THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. VOID IN PUERTO RICO AND WHERE PROHIBITED BY LAW. Employees of Kohler Co. (the "Sponsor") and its respective affiliates, subsidiaries, promotion, advertising and promotional agencies and the immediate family members and persons living in the households of each are not eligible to enter. By participating, entrants agree to be bound by these Official Rules.

2. PROGRAM DESCRIPTION: Promotion begins at 12:01 a.m. (CT) on August 1, 2009, and will end at 11:59 p.m. (CT) on December 31, 2011 (the "Promotional Period"). Prizes will be awarded in monthly random drawings from among all eligible entries received. The approximate date of each drawing will be the first day of each month from January 2011 to January 2013.

3. TO ENTER: Complete and submit electronically the Registration Form. You will be required to provide your e-mail address, first and last name, occupation description, zip code or postal code, and country. Additional information on the Registration Form is not required. Entrants must complete all required information on the online entry form to be eligible. You may also enter by legibly hand-printing your complete full name and e-mail address on a 3.5" x 5" postcard (only 3.5" x 5" postcards will be considered eligible), mailing your entry to Kohler Showerhead Giveaway, 444 Highland Drive, MS 019, Kohler, WI 53044.

Multiple entries submitted by a single entrant are void. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited, and that participant�s entries and that participant will be disqualified. Sponsor assumes no responsibility for lost, late or misdirected entries, or for any computer, online, telephone, or human error or technical malfunctions that may occur. All entries become the property of Sponsor and will not be acknowledged or returned.

4. WINNER SELECTION & NOTIFICATION: Winners will be selected in random monthly drawings held on or about the first day of each month from January 2011 to January 2013 from all eligible entries received by Sponsor, whose decisions are final and binding in all matters relating to this sweepstakes. Limit one prize per eligible entry during the Promotional Period. Previous winners are exempt from future drawings. Winners will be notified by e-mail on or about the day of each monthly drawing. Potential winner may be required to execute and return and Affidavit of Eligibility and Liability and where legal a Publicity Release within 14 days following the date of issuance of notification. Non-compliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternative winner.

5. PRIZES/ODDS: One prize will be awarded in each monthly drawing: a Fort�® eco-friendly 1.75gpm showerhead (K-10240-CP) in Polished Chrome with a total approximate retail value of $84.95.

Each winner will be responsible for paying all costs and expenses related to his or her prize that are not specifically mentioned, including but not limited to all federal, state and local income taxes. No substitution, barter, transfer, or assignment of prize will be permitted, and non-cash prizes cannot be redeemed for cash. Sponsor reserves the right to substitute prize with prize of equal or greater value if advertised prize becomes unavailable. Odds of winning depend on number of eligible entries received.

6. GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules Except where legal prohibited, winners grant (and agree to confirm that grant in writing) permission for Sponsor and those acting under its authority to use winner�s name, picture, likeness and biographical information and statements, at any time or times, for advertising and promotional purposes without additional compensation, notice, review or approval.

Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry and the potential winners may be requested to provide Sponsor with proof that the potential winners are the authorized account holder and satisfies all eligibility requirements. Should any portion of the sweepstakes be, in Sponsor�s sole opinion compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Sweepstakes. Sponsor is not responsible for any error, omission, deletion or failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant�s computer related to or resulting from participation in this contest. Kohler Co. reserves the right to make any revisions to the official rules at any time.

By entering, participants release and hold harmless Sponsor and its respective subsidiaries, affiliates, directors, officers, prize suppliers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Sweepstakes or acceptance or use of prize. In no event will Sponsor, its parent, affiliates, subsidiaries and related companies, their advertising or promotion agencies or their respective officers, directors, employees, representatives and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the web site or downloading from and/or printing material downloaded from said website. Without limiting the foregoing, everything on this website is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations of exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you.

8. DISPUTES. Participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Wisconsin or the appropriate Wisconsin State Court located in Milwaukee, Wisconsin; (ii) all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with this sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of the State of Wisconsin or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Wisconsin.

9. WHO WON: To receive the names of each monthly winner by mail after the first day of every month until January 2013, please mail a self-addressed stamped envelope to Kohler Showerhead Giveaway, 444 Highland Drive, MS 019, Kohler, WI 53044. Vermont residents may omit return postage to receive copy of the Official Rules.
